General Terms and Conditions

These general terms and conditions are entered into between

Flamingo Prodigy Unipessoal LDA: Febronie Desage-Bonnet - 18 Rua Das Taipas - 1250-266 Lisbon, Portugal. VAT No. FR64825033582, www.febronie.com, hereinafter referred to as "the Site," and any individual or legal entity, hereinafter referred to as "the Customer." The Site sells household linens: bed linens, decorative textiles, foutas, beach towels, cushion covers, and related products. It is specified that the products are intended for the Customer's personal use only, with no direct connection to their professional activity. Customers wishing to purchase from the Site declare that they have full legal capacity.

PRODUCTS

The photos on the website, while as accurate as possible, are not contractually binding. Flamingo Prodigy Unipessoal LDA cannot be held responsible for any differences between a product and its photograph.




PRICES AND ORDERS

Any product order implies the buyer's unreserved acceptance of and full adherence to these general terms and conditions of sale.
Orders are placed on the Febronie.com website.
Flamingo Prodigy Unipessoal LDA undertakes to fulfill orders received on the Site only within the limits of available stock. If a product is unavailable, Flamingo Prodigy Unipessoal LDA undertakes to inform the Customer and, if applicable, to refund them without delay and at the latest within fourteen days of the Customer's acceptance of the order.
Prices are shown in Euros, inclusive of all taxes. They are subject to change at any time. They include VAT applicable on the date of the order. Any change in the applicable rate may be reflected in the product prices.
Ownership of the products delivered to you will only be acquired after full payment of their price.
However, in accordance with Article L. 122-1 of the Consumer Code, Flamingo Prodigy Unipessoal LDA reserves the right to refuse the order if it is abnormal, placed in bad faith or for any other legitimate reason, and in particular, when there is a dispute with the Customer concerning the payment of a previous order.





PAYMENT AND INVOICING TERMS

Payments can be made by credit card via Shopify Pay. All information is encrypted and is not accessible to our company.
Any additional bank charges are the responsibility of the Client.
An invoice containing the mandatory provisions set out in Articles L 121-18 and L 121-19 of the Consumer Code is sent to the Customer when the order is placed and/or as soon as the order is registered and the price is paid by the Customer.
Orders paid by credit card are prepared the same day (working days) if they are registered before 12:00 or the following working day.


DELIVERY
Shipping costs are payable in Metropolitan France (including Corsica) for any order less than 39 Euros including VAT.
Orders are then delivered via the usual postal services, and in particular through the "DPD Direct" service under which DPD commits to delivering within 48 hours.
Flamingo Prodigy Unipessoal LDA therefore declines all responsibility in the event of excessive delivery delays due to postal services, as well as in the event of loss of ordered products or postal service strikes.
In any event, the order will be processed within thirty (30) days from the day following the date the Customer validates their order. Once registered, the order will be delivered to the address provided by the Customer.
The order is sent as soon as payment is received.
Upon receipt of the ordered products, the Customer must verify their conformity. Any anomaly concerning the delivery (missing product, damaged package, etc.) must be noted by the Customer on the delivery receipt presented by the postal service at the time of delivery and must also be reported to Flamingo Prodigy Unipessoal LDA's customer service department by email to hello@febronie.com between 9:30 a.m. and 6:30 p.m., Monday to Friday. Any claim made after 48 hours will be rejected, and Flamingo Prodigy Unipessoal LDA will be released from all liability.
You are solely responsible for any delivery failure due to incomplete or incorrect information provided during the ordering process. The delivery address cannot be changed after the order is placed. The product is considered delivered to the address you provided as soon as it is received there by you or a third party. Similarly, if you are not present at the address provided, delivery to a collection point has the same legal effect as delivery directly to you.


DELIVERY DELAY
Delivery times are provided for informational purposes only. If delivery exceeds thirty days from the date of the order, the sales contract may be cancelled and the Customer reimbursed for any sums already paid, excluding any compensation or damages. (See Article L 121-20-3 of the French Consumer Code).
In the event of a delivery delay, the Customer must notify Flamingo Prodigy Unipessoal LDA's customer service department as soon as possible by email to hello@febronie.com. Flamingo Prodigy Unipessoal LDA will then contact the postal service to initiate an investigation. Postal investigations can take a considerable amount of time.
Flamingo Prodigy Unipessoal LDA will not be responsible for any loss, sending to an incorrect address or delay in delivery of a product.

PERSONAL INFORMATION
Providing the personal information collected during the online sales process is mandatory, as this information is necessary for processing and delivering orders, as well as for issuing invoices. This information is strictly confidential. Failure to provide this information will result in the automatic rejection of the order.
In accordance with French Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, the processing of personal information collected on the Site has been declared to the French Data Protection Authority (CNIL). The Customer has the right to access, modify, rectify, and delete their personal data. To exercise this right, the Customer must send a letter to customer service:

PRODUCT RETURNS
When a customer wishes to return an item for the following reasons: the item is no longer wanted, the style/color/size ordered is unsuitable, or the item differs from the website description, they must go to their customer account and click on the "I wish to return my product" button, then fill out the "Reason for Return" form. Once validated, the customer must print this form and place it inside the package, affixing the label generated afterward with the necessary shipping information. The product must be returned in its original packaging and box in perfect condition. Products that are soiled, folded, damaged, stained, or washed will not be accepted by FEBRONIE. Return shipping costs are the responsibility of the customer (item no longer wanted, late delivery, style/color/size ordered is unsuitable, or the item differs from the website description). In the exceptional case where a return is justified by a product defect, the customer must send an email to hello@febronie.com explaining the defect. In this specific case, the return shipping costs will be borne by Flamingo Prodigy Unipessoal LDA. Returned products must be shipped to the address indicated below: MOBILTRON France SAS FEBRONIE 8 Avenue d'Helmstedt (Near Festivitré) 35500 VITRE FRANCE. When shipping returned products to our warehouse, we advise you to keep the tracking number, as we will not be responsible in the event of loss of the package by the postal service.


ORDER VERIFICATION UPON ARRIVAL
You are required to check the condition of the packaging and the items upon delivery. It is your responsibility to note any reservations or complaints you deem necessary, or even refuse the package, if it is visibly damaged upon delivery.
Such reservations and claims must be addressed to the carrier by registered letter with acknowledgment of receipt within three working days, excluding public holidays, following the date of Delivery of the Goods.
The Customer must also send a copy of this letter to Flamingo Prodigy Unipessoal LDA. Failure to file a claim within the aforementioned period extinguishes any right of action against the carrier in accordance with Article L. 133-3 of the French Commercial Code.
You must ensure that the goods delivered correspond to the order. In the event of non-conformity of the goods, either in nature or quality, with the specifications mentioned in the Delivery Note, the Customer must inform Flamingo Prodigy Unipessoal LDA by email at hello@febronie.com and return the goods to the following address: MOBILTRON France SAS FEBRONIE, 8 Avenue d'Helmstedt (Near Festivitré), 35500 VITRE, FRANCE


RIGHT OF WITHDRAWAL
You have a right of withdrawal which you may exercise within fourteen calendar days following the date of receipt or collection of the Order, without giving any reason or incurring any financial penalty. If this period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.
You have 14 days from the date of notification of your withdrawal decision to send us the product(s) concerned.
If you exercise your right of withdrawal within fourteen days of receiving the product, only the price of the product(s) purchased and the shipping costs will be refunded; return shipping costs will remain your responsibility.
Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing for resale as new, and must be accompanied by the order reference number. You may be held liable for any depreciation of the product resulting from handling.
You can exercise your right of withdrawal by email, provided you include the product order number (hello@febronie.com). You must return the products no later than fourteen days after notifying us of your withdrawal.
The price of returns, which is the responsibility of the Customer, can be found on the Chronopost website (www.chronopost.fr).
If you exercise your right of withdrawal, Flamingo Prodigy Unipessoal LDA will reimburse all payments received from you (including delivery charges, but excluding return shipping costs) no later than 14 days from the date on which Flamingo Prodigy Unipessoal LDA is informed of your decision to withdraw, using the same payment method you used for the initial transaction. This reimbursement will be delayed until the product has been received or until you have supplied evidence of having sent back the product, whichever is the earliest. Flamingo Prodigy Unipessoal LDA is not obligated to reimburse any additional costs if you expressly chose a more expensive delivery method than the standard delivery option offered by the online store www.febronie.com.

RISKS AND GUARANTEES
The products sold comply with current French legislation and applicable standards in France and the European Union. All items presented benefit from the legal guarantees of conformity (Article L 211-4 et seq. of the French Commercial Code) and against hidden defects (Articles 1641 to 1649 of the French Civil Code).
Non-conforming product(s): Any non-conforming product, to be exchanged or refunded, must be returned to Flamingo Prodigy Unipessoal LDA in its original packaging and condition, along with the delivery note, to the following address: MOBILTRON France SAS FEBRONIE 8 Avenue d'Helmstedt (Near Festivitré) 35500 VITRE FRANCE. It is specified that shipping costs are borne by Flamingo Prodigy Unipessoal LDA in cases where the return is due to an error on the part of Flamingo Prodigy Unipessoal LDA. Contract conclusion: The contract between Flamingo Prodigy Unipessoal LDA and the Customer is concluded once payment has been received and the items have been delivered to the Customer's address.
