VAT FR64825033582, www.febronie.com, hereinafter referred to as "the Site" and any natural or legal person, hereinafter referred to as "the Customer". The Site's business is the sale of household linen: bed linen, textile decoration, foutas, beach towels, cushion covers and derivative products. It is specified that the products are intended for the personal use of the Customer, without any direct connection with the Customer's professional activity. The Customer who wishes to purchase on the site declares to have full legal capacity.
PRODUCTS
The photos on the website, although as accurate as possible to the reality of the product, cannot be contractually binding. Flamingo Prodigy Unipessoal LDA cannot be held responsible for any differences that may exist between a product and its photograph.
PRICES AND ORDERS
Any order for a product implies unreserved acceptance by the buyer and full adherence to these general conditions of sale.
Orders are placed on the Febronie.com website.
Flamingo Prodigy Unipessoal LDA undertakes to honor orders received on the Site only within the limits of available stocks. In the event of unavailability of the product, Flamingo Prodigy Unipessoal LDA undertakes to inform the Customer and, if applicable, to reimburse them, without delay and at the latest within fourteen days from the Customer's acceptance of the order.
Prices are listed in Euros, inclusive of all taxes. They are subject to change at any time. They reflect the VAT applicable on the day the order is placed. Any change in the applicable rate may be reflected in product prices.
Ownership of the products delivered to you will only be acquired after full payment of their price.
However, in accordance with Article L. 122-1 of the Consumer Code, Flamingo Prodigy Unipessoal LDA reserves the right to refuse the order if it is abnormal, made in bad faith or for any other legitimate reason, and in particular, when there is a dispute with the Customer concerning the payment of a previous order.
PAYMENT AND INVOICING TERMS
Payments can be made by credit card via Shopify Pay. All information is encrypted and is not shared with our company.
Any additional bank charges are the responsibility of the Customer.
An invoice containing the mandatory provisions set out in Articles L 121-18 and L 121-19 of the Consumer Code is sent to the Customer when the order is placed and/or upon registration of the order and payment of the price by the Customer.
Orders paid by credit card are prepared the same day (working days) if they are recorded before 12:00 p.m. or the following working day.
DELIVERY
Shipping costs are payable in Metropolitan France (Corsica included) for any order less than 39 Euros including tax.
Orders are then sent via the usual postal services, in particular using the "Colissimo suivi" service, which La Poste promises to deliver within 48 hours.
Flamingo Prodigy Unipessoal LDA therefore declines all responsibility in the event of excessive delivery delays due to postal services, as well as in the event of loss of ordered products or postal service strikes.
In any event, the order will be executed at the latest within thirty (30) days from the day following the validation of the order by the Customer. Once registered, the order will be delivered to the address indicated by the Customer.
The order is sent upon receipt of payment.
Upon receipt of the ordered products, the Customer must check the conformity of these products. Any anomaly concerning the delivery (missing product, damaged package, etc.) must be reported by the Customer on the receipt that the Post Office will present to him at the time of delivery of the package and must imperatively be notified to the customer service of Flamingo Prodigy Unipessoal LDA, by e-mail addressed to hello@febronie.com from 9:30 a.m. to 6:30 p.m. from Monday to Friday. Any complaint made after a period of 48 hours will be rejected and Flamingo Prodigy Unipessoal LDA will be released from all liability.
You are solely responsible for any delivery failure due to a lack of information when ordering. The delivery address cannot be changed after ordering. The product is deemed delivered to the address provided by you, as soon as the product is collected there by you or a third party. Similarly, if you are not present at the address provided, delivery to a relay point has the same effects as delivery to your hands.
DELAY IN DELIVERY
Delivery times are given for information purposes only. If they exceed thirty days from the order, the sales contract may be terminated and the Customer reimbursed for any amounts already paid, excluding any compensation or damages. (see Article L 121-20-3 of the Consumer Code).
In the event of a delivery delay, the Customer must report this delay as soon as possible to Flamingo Prodigy Unipessoal LDA's customer service by email at hello@febronie.com. Flamingo Prodigy Unipessoal LDA will then contact the postal services to initiate an investigation. A postal investigation may take a long time.
Flamingo Prodigy Unipessoal LDA will not be responsible for any loss, misdirection or delay in delivery of a product.
PERSONAL INFORMATION
Providing personal information collected for distance selling is mandatory, as this information is necessary for processing and delivering orders and for issuing invoices. This information is strictly confidential. Failure to provide this information will result in the order being automatically rejected.
In accordance with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the processing of personal information collected on the Site has been declared to the National Commission for Information Technology and Freedoms. PRODUCT RETURNS
When the customer wishes to make a return for the following reasons: The item is no longer desired The style/color/size ordered is not suitable Different from the description on the website He must go to his customer area and click on the button "I wish to return my product" then fill out the "reason for return" form. Once validated, the customer must then print this form and place it inside the package and stick on it the label generated subsequently with the necessary information for shipping. CHECKING THE ORDER UPON ARRIVAL
You are responsible for checking the condition of the packaging and the items upon delivery. It is your responsibility to make any reservations or complaints you deem necessary, or even to refuse the package if it is clearly damaged upon delivery.
The said reservations and complaints must be addressed to the carrier by registered letter with acknowledgement of receipt within three working days, not including public holidays, following the date of Delivery of the Goods.
The Customer must also send a copy of this letter to Flamingo Prodigy Unipessoal LDA. Failure to file a complaint within the aforementioned time limit extinguishes any action against the carrier in accordance with Article L. 133-3 of the French Commercial Code.
You must ensure that the delivered goods correspond to the order. RIGHT OF WITHDRAWAL
You have the right to withdraw from the Order within fourteen calendar days of the date of receipt or collection, without giving any reason or financial penalty. If this period expires on a Saturday, Sunday, or a public holiday, it is extended until the next working day.
You have 14 days following notification of the decision to withdraw to send us the product(s) concerned.
If you exercise your right of withdrawal within fourteen days of receiving the product, only the price of the product(s) purchased and the shipping costs will be refunded, with the return costs remaining your responsibility.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold as new, and accompanied by the order reference number. In the event of depreciation of the product resulting from handling, you may be held liable.
You can exercise your right of withdrawal by email, provided you indicate the product order number (hello@febronie.com). You must return the products no later than fourteen days following the declaration of withdrawal.
The cost of returns, payable by the Customer, can be viewed on the Chronopost website (www.chronopost.fr).
In the event of exercising the right of withdrawal, Flamingo Prodigy Unipessoal LDA will reimburse the sums paid (including delivery costs, excluding return costs) no later than 14 days from the date on which Flamingo Prodigy Unipessoal LDA is informed of your decision to withdraw and using the same means of payment as that used for the order. This reimbursement date will be deferred until recovery of the product or until you have provided proof of shipment of the product, whichever comes first. Flamingo Prodigy Unipessoal LDA is not required to reimburse you for additional costs if you have expressly chosen a more expensive delivery method than the standard delivery method offered by the store www.febronie.com
RISKS AND GUARANTEES
The products sold comply with current French legislation and the standards applicable in France and the European Union. All items presented benefit from legal guarantees of conformity (Article L 211-4 et seq. of the French Commercial Code) and hidden defects (Articles 1641 to 1649 of the French Civil Code).
Non-compliant product(s): any non-compliant product, to be exchanged or refunded, must be returned to Flamingo Prodigy Unipessoal LDA in its original packaging and wrapping, and accompanied by the delivery note, to the following address: MOBILTRON France SAS FEBRONIE 8 Avenue d´Helmstedt (Near Festivitré) 35500 VITRE FRANCE It is specified that the shipping costs are the responsibility of Flamingo Prodigy Unipessoal LDA in the event that the return decision is the result of an error on the part of Flamingo Prodigy Unipessoal LDA. Conclusion of the contract: The contract between Flamingo Prodigy Unipessoal LDA and the Customer is concluded once payment has been received and the items have been delivered to the Customer's address.
